The US judge temporarily blocked the Trump administration’s attempt to deport dozens of non -accompanied children returned to their home country.
The Judge of the District Court Sparkl Soknanan was in response to the reports that the children were put on the planes and were going to send to Guatemala, where lawyers claimed that they would threaten abuse and persecution.
The children came to the United States alone and are in custody as they evaluate their immigration requirements.
Guatemala President Bernardo Arealo and the lawyers of the US Department of Justice and stated that children were not deported, but rather repatriated so that they could be united with their family.
President Arealelo criticized the resolution and promised to continue to fight for children to return home under the pilot program, which he proposed to President Trump.
The court proceedings were caused early on Sunday when immigrant advocacy groups were asked to conduct an emergency, arguing that about 600 children can be put on Texas aircraft and deported.
Then Judge Soknanan issued a temporary restrictive order that forbids officials to send a group of 10 migrant children aged 10 to 17 years before Guatemala.
At a hastily agreed hearing on Sunday afternoon Judge Soknanan, who was nominated by former President Joe Biden, expanded the order for covering all children who are not accompanied, believe that deportation is threatening. The order will be set for 14 days.
At the hearing, Judge Soknanan sought the assurance of Trump administrators that the planes had not yet departed with the children on board.
Deputy Assistant Prosecutor General Drew Esin said all the planes “in the field” in the United States. He told the judge, who may have taken off but returned.
Esin stated that flights were not part of deportation efforts, but for family reunification with parents and other relatives in Guatemala.
He also said that the Guatemalan government and the relatives of the children were asking for reunification. The lawyer groups said this did not meet at least some cases.
In the court’s submission, children have argued that the lawsuit violates federal laws aimed at protecting children who arrive only in the United States. They said some children had considered cases of immigration judges and expressed significant fears of return.
“On the night of Trump’s holidays, the Trump administration disrupted vulnerable, frightened children from their beds and tried to bring them back to danger in Guatemala,” – said in a statement Efrén C olivares, who filed a claim.
“We listen that the court prevented this injustice from occurring before hundreds of children have suffered irreparable harm.”
The White House Immigration Advisor Stephen Miller criticized the judge for blocking flights.
“The minors reported that their parents returned home to Guatemala,” he wrote on X. “But the Democratic judge refuses to allow them to reunite with their parents.”
Since the beginning of his second term, Trump has started efforts to eliminate dissatisfied migrants – a key promise of elections, which caused mass support during this campaign.
In June US Supreme Court cleared the way For Trump to restore migrant deportations to countries, except for their homeland, without allowing them to increase the risks they may face.
